Abstract

The Jurisprudence of Priorities and its controls are of great importance in identifying the order of acts and the basics of giving priority to some acts and delaying others. The Hanafi School is rich of issues from which the controls of the Jurisprudence of Priorities can be deduced due to its characteristics and nature. Al Mabsoot book By Al-Sarakhsi is a fertile source of issues. This study is concerned with following up issues of priorities in rules of purification and prayers according to the Hanafi School in Al Mabsoot and deducing the controls of Jurisprudence of Priorities from it using the descriptive approach based on the inference and analysis issues and the deductive approach to identify the controls of the Jurisprudence of Priorities. Then, it identifies the factors affecting Jurisprudence of Priorities, like the principles and grammatical rules of Hanafi jurisprudence, the wisdom and objectives of Sharia, Jurisprudence of balances, Rule of blocking excuses, Jurisprudence of reality and others. Moreover, it shows the issues of contemporary Islamic jurisprudence (if any) which built on these controls, emphasizing the significance of Jurisprudence of Priorities and the It’s need. it is concerned with a number of examples since it isn’t a statistical study. It doesn’t only refer to Al Mabsoot, but also mentions other Hanafis books when needed for understanding the sources of priorities to achieve the main objective, namely determining the controls of the Jurisprudence of Priorities according to the Hanafi school and its basics in the rules of purification and prayers.
